Terms of Service

As of 14 October 2026. This is a translation; the German version is binding.

1. Scope and provider

  1. These terms govern the use of BlockImagine at app.blockimagine.com. The provider and your contracting party for using it is BlockImagine, owner Michael Sieminski, c/o IP-Management #3642, Ludwig-Erhard-Str. 18, 20459 Hamburg, Deutschland, email: contact@blockimagine.com ("we").
  2. You also buy paid plans and credit packs from us. Payment is processed by our payment provider Stripe (Stripe Payments Europe, Ltd., Dublin); you can pay with the methods the payment page offers, such as card or PayPal. The contract is concluded when you complete the purchase on the payment page with the pay button. You receive the invoice and receipt by email.
  3. By signing in and by each further use you accept these terms. Users' own terms do not apply, even if we do not expressly object to them.

2. The service

  1. BlockImagine uses generative AI to create blocky 3D models with pixel textures and animations from descriptions and photos. You can view, change and download them in your browser.
  2. What each plan includes is shown on the "Plans and credits" page in the app. We may develop and change features, as long as the essential features of a paid plan remain for the current billing period.
  3. Results are created automatically by AI. They may differ from your description, contain mistakes or turn out differently for the same description. We do not owe any particular result. If a job fails completely, you get its credits back (section 4).

3. Account

  1. To use BlockImagine you need an account, which you create with your email address. You must be at least 16 years old.
  2. An account is personal. Do not pass on sign-in links, and do not create several accounts to get extra free credits. If you notice your account being misused, please tell us right away.

4. Plans, credits and payment

  1. You pay for jobs with credits. The app shows what an action costs, such as a new model or a change, before you start it. Credits are deducted when the job starts. If a job fails without a usable result or you cancel it, you get them back automatically.
  2. Every account starts on the free plan, which includes a small number of credits each month. Paid plans include more credits per month and are paid in advance monthly or yearly. On a yearly plan, too, you get the credits anew each month. Plan credits are valid until the end of their month; unused ones then expire and do not carry over.
  3. You can also buy any number of credit packs, on any plan. Bought credits do not expire as long as your account exists. Your plan's credits are used first, then bought ones.
  4. Credits have no cash value, cannot be transferred and are not paid out except under section 5 and section 10 paragraph 3.
  5. The app shows prices, credit amounts and billing periods before you buy. Paid plans renew automatically for one billing period at a time until you cancel. You can cancel at any time, effective at the end of the current period, through "Manage or cancel" on the "Plans and credits" page, through "Cancel contracts here" at the bottom of every page (also without signing in), through the link in your invoice email or by email to contact@blockimagine.com. Your plan stays active until then. Once a yearly plan has renewed beyond its first year, you can also cancel it at any time with one month's notice by email to contact@blockimagine.com; we refund the price of the full months no longer used afterwards pro rata.
  6. We announce price changes for an active plan by email at least 30 days in advance. They apply from the next period after that; if you do not agree, you can cancel before then.
  7. To keep the service stable for everyone, we may limit the size, duration and number of simultaneous jobs. If you reach a limit, the app tells you.

5. Refunds

  1. Request refunds by email to contact@blockimagine.com.
  2. Within 14 days of a purchase we refund it without giving reasons: a plan's first payment, each renewal and each credit pack. If you have already used credits from that purchase, we refund the share of unused credits. With the refund, the purchase's credits are removed; for a plan, it ends immediately.
  3. If BlockImagine does not work for a longer time for reasons we are responsible for, we also refund appropriately after the 14 days. Just write to us.
  4. Refunds go to the original payment method, usually within 14 days of approval. We may refuse them if we suspect fraud or repeated refund abuse.
  5. Please contact us before you reverse a payment with your bank or PayPal. While a chargeback is being reviewed, we may suspend access to paid features.
  6. Your statutory rights, in particular the consumer right of withdrawal (section 5a), remain unaffected. Where the law gives you more rights than this section, those apply.

5a. Right of withdrawal

If you are a consumer, you have a right of withdrawal as set out here.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (BlockImagine, owner Michael Sieminski, c/o IP-Management #3642, Ludwig-Erhard-Str. 18, 20459 Hamburg, Deutschland, email: contact@blockimagine.com) of your decision to withdraw from this contract by an unequivocal statement (for example an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract. What has been provided is the share of the purchase's credits you have used.

Model withdrawal form

If you wish to withdraw from the contract, please complete and return this form.

6. Your input

  1. You are responsible for your descriptions, photos and change requests. Only use content you have the necessary rights to.
  2. In particular, content is not allowed that breaks the law, infringes the rights of others (such as copyright, trademark or personality rights), insults, threatens or demeans others, glorifies violence, shows symbols of unconstitutional organisations or sexualises minors. Only upload photos of recognisable people with their consent.
  3. It is also not allowed to use BlockImagine for fraud or spam, to get around usage limits or security measures, to introduce malware, to probe for vulnerabilities, to query the service automatically or excessively, or to disrupt its operation.
  4. You grant us the simple, free right to store and process your input, pass it on to the service providers named in the privacy policy and show it to you, as far as BlockImagine needs this. The right ends when the content is deleted. Without your consent we do not publish your input or models or use them for advertising.

7. Rights to the results and to BlockImagine

  1. To the extent we hold any rights to the generated models, textures and animations, you may use, edit and pass them on without limits in time or place, including commercially and on every plan. We only keep the right to store and process them to run BlockImagine.
  2. AI-generated results may not be protected by copyright. Similar results may be created for other users too.
  3. We do not check whether a result infringes the rights of others, for example when a description is meant to recreate a well-known character or brand. Whether you may use a result the way you intend is your responsibility.
  4. BlockImagine itself, meaning its software, design, name and logo, remains our property. You only get the right to use the service under these terms.

8. Availability and backups

  1. We aim for smooth operation but cannot promise an uninterrupted or error-free service. Maintenance, outages at service providers or failed jobs can happen.
  2. We store your models carefully. Still, download important models so you have your own copy.

9. Liability

  1. We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, for fraudulently concealed defects and under a guarantee.
  2. For slight negligence on paid plans we are liable only for breaching essential contractual obligations, meaning those whose fulfilment makes proper performance of the agreement possible in the first place and on which you may regularly rely. This liability is limited to the foreseeable damage typical for the contract.
  3. On the free plan we are not liable beyond that (in line with sections 521 and 599 of the German Civil Code).
  4. These rules also apply to the people we use to perform our obligations.

10. Term, suspension and termination

  1. The agreement to use BlockImagine runs indefinitely. You can end it at any time without notice, through "Cancel contracts here" or by asking us by email to delete your account. Cancel a paid plan first under section 4 paragraph 5. Unused credits are lost with the deletion; we will point this out beforehand.
  2. If you seriously or repeatedly breach these terms, if there is a security or fraud risk, or if a payment is not made or is reversed, we may block or delete the content concerned and suspend your account temporarily or permanently. We take into account how serious the breach is and your legitimate interests.
  3. We can end the agreement with two weeks' notice by email, for a paid plan no earlier than the end of the current period. If we end it this way or discontinue BlockImagine, we refund unused bought credits pro rata. Either side's right to terminate for good cause remains unaffected.
  4. After the agreement ends we delete your account and models as described in the privacy policy. Download anything you want to keep beforehand.

11. Changes to these terms

If we change these terms, we email you the new version at least two weeks before it takes effect. If you do not agree, you can end the agreement before then; a paid plan also with immediate effect against a pro-rata refund. If you keep using BlockImagine afterwards, the new version applies; the email will point this out. Price changes are covered by section 4 paragraph 6.

12. Contact and final provisions

  1. Questions, cancellations and refund requests reach us at contact@blockimagine.com.
  2. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this applies only insofar as it does not deprive you of the protection of mandatory provisions of the country where you habitually reside.
  3. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Hamburg.
  4. We do not take part in dispute resolution proceedings before a consumer arbitration board.
  5. If individual provisions are invalid, the rest of the agreement remains valid.
